What DeKalb County State Court Handles

State Court is a Georgia county-level trial court. Its jurisdiction covers misdemeanors, traffic prosecutions, and civil matters not exclusively reserved to Superior Court. State Court does not hear felony cases, divorces, or major equity matters. Those go to Superior Court. State Court also does not handle small claims, dispossessory, or initial warrants. Those go to Magistrate Court.

DeKalb State Court is high volume because of the population and traffic density in the county. State Court is the right venue for most misdemeanor and traffic matters arising out of DeKalb law enforcement activity. The Superior Court page covers the general-jurisdiction court, and the Magistrate Court page covers the lower court's small claims and warrant duties.

Misdemeanor Cases in DeKalb State Court

Most DeKalb misdemeanor prosecutions are filed in State Court. The Solicitor-General prosecutes State Court misdemeanors. Cases run from accusation through pretrial motions, plea negotiations, and either a plea or a trial. State Court juries are available for misdemeanors. Sentences typically include fines, probation, community service, or short jail terms.

The criminal records page covers the broader criminal case framework, including charges-vs-convictions and Georgia record restriction under O.C.G.A. ยง 35-3-37.

Traffic Cases in DeKalb State Court

State Court is the busiest DeKalb traffic court for county-issued citations. Traffic prosecutions in State Court range from minor speeding to DUI and reckless driving. The State Court traffic division publishes payment and contest procedures. City police traffic tickets generally route to the issuing city's municipal court, not DeKalb State Court.

For a full traffic-case framework, see traffic court records. For DUI, which is a criminal-traffic hybrid, see criminal records.

State Court Civil Matters

State Court hears civil cases not exclusively reserved to Superior Court. Tort cases, contract disputes, debt collection, and personal injury matters under a defined dollar threshold often sit in State Court. A State Court civil action is filed with the State Court Clerk and follows civil procedure rules similar to Superior Court but with State Court forms and fee schedules.

State Court Garnishment

Garnishment to collect on a judgment can be filed in State Court when the underlying judgment was entered there, or transferred from Superior or Magistrate to State Court depending on the case. The garnishment process serves the third-party employer, bank, or other property holder and requires the garnishee's formal answer.

A garnishee who fails to answer can face default. A debtor who claims an exemption files a claim with the court. Garnishment law is technical; pro se filers should consult counsel or self-help resources before filing.

Differences From Magistrate Court

Magistrate Court is a different lower-court venue from State Court. Magistrate handles small claims, dispossessory, garnishment applications, arrest warrants, first appearances, and preliminary hearings. State Court handles misdemeanor prosecution, traffic, and the broader civil docket. A DeKalb litigant who is unsure which court has the case should read the case caption or contact the clerk.

The Magistrate Court page covers small claims, dispossessory, and warrant work. The warrant records page covers warrant types and resolution.

The State Court Clerk Office

The DeKalb State Court Clerk maintains State Court case files, processes payments, supports the court calendar, and issues certified copies. The official page is dekalbgastatecourt.gov/clerk. The State Court Clerk page covers the clerk's services, fee schedule, and certified copy process.

The State Court Clerk is separate from the Clerk of Superior Court. A traffic ticket or misdemeanor copy must come from the State Court Clerk, not from the Superior Clerk. The Clerk of Superior Court page covers the Superior Clerk routing for Superior Court documents.

Searching State Court on Odyssey

Set the Smart Search location dropdown to "DeKalb State and Magistrate Courts" and search by citation number, case number, or party name. For a traffic ticket, the citation number is the fastest search. For a misdemeanor, the case number or party name and a date range work.

The portal's case-type filter has options for criminal and civil case types. The status filter allows narrowing by Open, Closed, Dismissed, or other dispositions. Smart Search does not search warrants in its public configuration. The Sheriff's warrant unit is the right contact for warrant verification.

State Court Calendar and Dockets

For State Court calendar lookups, use Search Hearings with location set to "DeKalb State and Magistrate Courts" and hearing type set to "All State and Magistrate Courts." Required fields include search type, search criteria, and a date range. The court dockets page covers Search Hearings in detail.

A docket is not a substitute for a court notice. A continuance can post late, and a calendar can change. For a real court appearance, call the clerk or confirm with counsel before relying on a portal entry.
